Clear rules for using Xervs.
These terms set expectations for customers, sellers and everyone using the marketplace.
1. Agreement and eligibility
By using Xervs you agree to these terms and our Privacy Policy. You must be at least 18 years old and legally able to enter contracts. If you act for a business, you confirm that you may bind that business.
2. Marketplace role
Xervs provides a marketplace where independent customers and sellers can transact. Unless a listing expressly states otherwise, the seller—not Xervs—provides the listed goods or services and is responsible for their legality, quality, safety and accuracy.
3. Accounts
You must provide accurate information, keep credentials confidential and promptly report suspected unauthorised use. You are responsible for activity performed through your account. We may verify information, restrict access or close accounts used fraudulently or contrary to these terms.
4. Listings and seller duties
Sellers must describe offerings and prices accurately, hold all required licences and insurance, honour confirmed bookings, comply with applicable law and avoid misleading, unsafe, infringing or prohibited content. Sellers remain responsible for tax and regulatory obligations arising from their activity.
5. Bookings, cancellations and refunds
A booking becomes confirmed when payment and any seller acceptance requirements are completed. The cancellation and refund rules shown with the listing or during checkout form part of the booking. Where no specific rule is displayed, contact support before cancelling. Approved refunds are returned through the original payment method and processing times depend on the payment provider.
6. Payments and fees
Prices are displayed in the stated currency. You authorise our payment provider to process the amount confirmed at checkout. Additional bank or currency-conversion charges are your responsibility. Xervs may introduce or change clearly disclosed marketplace fees prospectively.
7. Prohibited conduct
You may not commit fraud, circumvent the marketplace, scrape or disrupt the service, upload malware, misuse personal information, impersonate another person, manipulate reviews, infringe intellectual property, or list or purchase unlawful goods or services.
8. Content
You retain ownership of content you submit and grant Xervs a worldwide, non-exclusive licence to host, reproduce, adapt and display it for operating and promoting the marketplace. You confirm that you have the necessary rights. We may remove content that violates these terms or applicable law.
9. Disclaimers and liability
The service is provided on an “as available” basis to the extent permitted by law. Xervs does not guarantee uninterrupted availability or the conduct of marketplace participants. Nothing in these terms excludes liability that cannot legally be excluded. Otherwise, Xervs is not liable for indirect or consequential loss, and its aggregate liability relating to a transaction will not exceed the amount paid through Xervs for that transaction.
10. Suspension and termination
You may stop using Xervs at any time. We may suspend or terminate access where reasonably necessary for security, legal compliance, non-payment or a material breach. Provisions intended by their nature to survive termination will continue to apply.
11. Governing law and disputes
These terms are governed by the laws of Namibia. Please contact us first so we can try to resolve a dispute informally. Subject to any mandatory consumer rights, disputes fall under the jurisdiction of the courts of Namibia.
12. Changes and contact
We may update these terms prospectively. Material changes will be communicated through the service or by email where appropriate. Questions may be sent to support@xervs.com.
